Homeopathy: The Council of State Delivers the Final Judicial Blow
In 2018 I was in the background of a war in court: Homeopathic "doctors" sued against scientific medical doctors, accusing them of breaching the shitty code of conduct or medical doctors.
Yes, you read that right: Homeopaths sued and claimed that criticizing homeopaths is breach of code of conduct.
Here is a collection by the TG-1 about the affair:

The appeal of 124 health professionals against "alternative medicine"

The appeal of 124 health professionals against "alternative medicine"
Doctors and health professionals have decided to warn about fanciful promises and unproven efficacy of so-called alternative medicines like homeopathy. This group demands the exclusion of these esoteric disciplines from the medical field.
The Hippocratic Oath is one of the oldest known ethical commitments. It requires the doctor to provide the best possible care and in the most honest way. These two requirements require him to continually seek to improve his knowledge and inform those who seek his care about what he can reasonably propose, as well as what is unnecessary or against-indicated. It is easy and rewarding to display your knowledge. It is much more difficult to explain and accept its limits. The temptation can then be great to practice care without any scientific basis. This temptation has always existed. She has been, and still is, nourished by charlatans of all kinds who seek the moral guarantee of the title of doctor to promote false therapies with illusory efficiency.
"The medical order tolerates practices that are at odds with its own Code of Ethics and the public authorities organize or even participate in the financing of some of these practices"
The obligation of honesty is enshrined in the Codes of ethics of the medical professions and the Code of public health (article 39 of the Code of ethics and article R.4127-39 of the Code of public health). They forbid charlatanism and deception, impose to prescribe and distribute only proven treatments. They also proscribe the use of secret remedies or not clearly mentioning the substances they contain. The Council of the Order of Physicians is responsible for ensuring that its members do not use their title to promote practices whose science has never proven useful or even dangerous. He must ensure that doctors do not become trade representatives of unscrupulous industries. It must sanction those who have lost sight of the ethics of their exercise.

However, in 2018, the medical order tolerates practices that are at odds with its own Code of Ethics, and the public authorities organize or even participate in the financing of some of these practices. Faced with ever more numerous and esoteric practices, and the growing mistrust of the public towards scientific medicine, we had to react with force and vigor.
"Homeopathy, like other" alternative medicines ", is in no way scientific. These practices are based on beliefs that promise a miraculous and safe recovery. "
Homeopathy , like other practices called "alternative medicine", is in no way scientific. These practices are based on beliefs that promise a miraculous and safe recovery. In September 2017, the Scientific Council of the Academies of European Sciences published a report confirming the lack of evidence of the effectiveness of homeopathy. In most developed countries, doctors are prohibited from prescribing homeopathic products.
The so-called "alternative" therapies are ineffective beyond the placebo effect and are no less dangerous. Dangerous, because they cure the useless by over-medicalizing the population and giving the illusion that any situation can be solved with a "treatment". Dangerous because they fuel and rely on a basic distrust of conventional medicine as shown by the unjustified polemics about vaccines. Finally, dangerous because their use delays diagnosis and necessary treatment, sometimes with dramatic consequences, especially in the treatment of serious diseases such as cancer.

These practices are also costly for public finances. Training is provided in structures receiving public money. Consultations are open in hospitals at the expense of other services. Some of these treatments are covered by Medicare, which is largely in deficit. Thus, homeopathic products can be reimbursed at 30% (and up to 90% in Alsace-Moselle) with a derogatory status exempting them from proving their effectiveness. This finances a prosperous industry whose representatives do not hesitate to insult seriously those who criticize them ("There is a Ku Klux Klan against homeopathy", accused the president of the world leader in the sector, Christian Boiron, in the newspaper Le Progress of July 15, 2016) or to sweep away the demands of scientific evidence.
Of these practices which are neither scientific nor ethical, but very irrational and dangerous, we wish to dissociate ourselves completely.
We urge the Council of the Order of Physicians and public authorities to make every effort to:
- no longer authorize the designation of doctors or health professionals who continue to promote them;
- no longer recognize in any way homeopathy, mesotherapy or acupuncture degrees such as medical diplomas or qualifications;
- no longer produce degrees in medical schools or health training institutions based on practices whose effectiveness has not been scientifically demonstrated;
- no longer pay social security contributions for care, medicine or treatment from disciplines that refuse to accept rigorous scientific evaluation;
- encourage information procedures on the nature of alternative therapies, their deleterious effects and their real effectiveness;
- require all caregivers to respect the ethics of their profession, by refusing to give unnecessary or ineffective treatment, by offering care in accordance with the recommendations of learned societies and the most recent data from science, by demonstrating pedagogy and honesty towards their patients and by offering a sympathetic listening.

Homeopathy: The Council of State Delivers the Final Judicial Blow
The Council of State overturns the disciplinary action against three doctors who signed a 2018 op-ed opposing homeopathy: their article, which was in the public interest, did not violate professional ethics.

Homeopathy has never proven its effectiveness.

They never would have imagined they'd get caught up in such a lengthy legal process. On March 19, 2018, 124 doctors and healthcare professionals from the #NoFakeMed movement published an op-ed in Le Figaro denouncing homeopathy. In their article, they called on public authorities to stop recognizing and funding practices whose effectiveness had not been proven.
The homeopathic doctors' unions then filed dozens of lawsuits - each with its own course of events - against the signatories, accusing them of breaching professional ethics.

Alternative Medicine: What Works, What Doesn't
Three of these cases, which reached the Council of State, were resolved on October 2: the sanctions against three signatory doctors were overturned. According to the court ruling, this op-ed is not "offensive or defamatory."
It addresses a topic of "public interest" that "refers to scientifically documented information," without being "likely to undermine confidence in the medical profession." The National Union of French Homeopathic Physicians was ordered to pay 3,000 euros to the three doctors named in the op-ed.
Homeopathy to Be Removed from Health Insurance Coverage Starting in 2021
Since the publication of this op-ed, homeopathy has been removed from the list of reimbursable treatments. After reviewing more than 1,000 studies, the Transparency Commission concluded that none demonstrated greater efficacy than a placebo or conventional treatments. The government at the time decided to phase out reimbursement gradually, with 15% of costs covered in 2020, followed by 0% as of January 1, 2021.

Withdrawal from Antidepressants: Between the Personal and the Scientific
"Following the scientific victory of the decision to remove these drugs from insurance coverage, today marks a kind of victory on both the ethical and legal fronts," says Dr. Pierre de Bremond d'Ars, president of the #NoFakeMed collective and a member of the departmental council of the Hauts-de-Seine Medical Association. "What doctors say has an impact on public health. When we express ourselves in a reasoned manner and in accordance with the code of ethics, it lends legitimacy to the debate. That is what the Council of State has reiterated today. "
Eight Years of "Gag Lawsuits"
Beyond these three cases brought before the Council of State, some 40 other cases are reportedly still pending. The group hopes that this decision will now set a legal precedent and put an end to eight years of "gag lawsuits" intended to "intimidate" the signatories.
"This decision paves the way for legitimate public health debates, which are far more important than the issue of homeopathy," says Dr. de Bremond d'Ars. It should help create a more peaceful environment for discussions within the profession. The #NoFakeMed collective is still active and continues its efforts to combat health misinformation. Since 2024, it has been a partner of the PROACT EU-Response consortium, a European pandemic preparedness project.

FRENCH REPUBLIC
IN THE NAME OF THE FRENCH PEOPLE
Having regard to the following procedure:
The Syndicat national des médecins homéopathes français lodged a complaint against Mr D... O... before the disciplinary chamber of first instance of the Nord-Pas-de-Calais of the Order of Physicians. By a decision of 26 February 2020, the disciplinary chamber of first instance dismissed its complaint.
By an order of 29 July 2025, the President of the national disciplinary chamber of the Order of Physicians, on appeal by the Syndicat national des médecins homéopathes français, set aside that decision and imposed on Mr O... the sanction of a warning.
By a summary appeal and a supplementary memorial, registered on 28 October 2025 and 28 January 2026 at the registry of the contentious section of the Conseil d'État, the departmental council of the Nord of the Order of Physicians and Mr O... request the Conseil d'État:
1°) to annul that order;
2°) to order the National Council of the Order of Physicians and the Syndicat national des médecins homéopathes français to pay the sum of 4,000 euros under Article L. 761-1 of the Code of Administrative Justice.
They contend that the order of the President of the national disciplinary chamber of the Order of Physicians which they challenge is vitiated by:
irregularity in that the challenge submitted to the national disciplinary chamber of the Order of Physicians, which did not form part of a series, ought to have been judged by a collegiate formation;
irregularity in that it held the appeal admissible even though the Syndicat national des médecins homéopathes français had not produced the deliberation of the body with statutory competence deciding to lodge an appeal against the decision of first instance;
error of law and incorrect legal characterisation of the facts in that it held that Mr O... had failed to comply with the requirements resulting from Article R. 4127-13 of the Public Health Code;
incorrect legal characterisation of the facts in that it held that Mr O... had failed to comply with the requirements resulting from Article R. 4127-56 of the Public Health Code.
The application was communicated to the Syndicat national des médecins homéopathes français, which did not file a memorial.
Pursuant to the provisions of Article R. 611-7 of the Code of Administrative Justice, the parties were informed that the decision of the Conseil d'État was liable to be based on the ground, raised of its own motion, that the departmental council of the Nord of the Order of Physicians, which was not a party to the proceedings in which the order of the President of the national disciplinary chamber of the Order of Physicians under challenge was delivered, is not entitled to appeal on a point of law against that decision.
By observations in reply to this ground raised of its own motion, registered on 6 July 2026, the departmental council of the Nord of the Order of Physicians and Mr O... contend that the departmental council of the Nord of the Order of Physicians must be regarded as having had the status of a party on appeal.
Having regard to the other documents in the file;
Having regard to:
the Public Health Code;
the Code of Administrative Justice;
After having heard in public session:
the report of Ms Anne Villette, Maîtresse des requêtes,
the submissions of Mr Jean-François de Montgolfier, Public Rapporteur;
Counsel for the departmental council of the Nord of the Order of Physicians and Mr O..., SCP Guérin-Gougeon, having been given the floor after the submissions.
Having regard to the following:
It appears from the documents in the file submitted to the judges of first instance that Mr O... co-signed, with one hundred and twenty-three other health professionals, an opinion piece published in a national daily newspaper entitled "How to deal with the rise of fake medicines" and calling into question so-called "alternative" therapies. The Syndicat national des médecins homéopathes français lodged a complaint on that account against Mr O... before the disciplinary chamber of first instance of the Nord-Pas-de-Calais of the Order of Physicians. By a decision of 26 February 2020, the disciplinary chamber dismissed its complaint. By an order of 29 July 2025 against which the departmental council of the Nord of the Order of Physicians and Mr O... appeal on a point of law, the President of the national disciplinary chamber of the Order of Physicians set aside that decision and imposed on Mr O... the sanction of a warning.
On the admissibility of the appeal insofar as it emanates from the departmental council of the Nord of the Order of Physicians:
The avenue of appeal on a point of law is open, according to the general principles of procedure, only to persons who had the status of a party in the proceedings that gave rise to the decision under challenge. The mere fact that a person was invited by the court to submit observations does not confer upon that person the status of a party to the proceedings before the judges of first instance. The position is otherwise only if that person would have had standing, had he or she not been present in the proceedings, to bring a third-party opposition against the decision delivered by the judges of first instance.
The departmental council of the Nord of the Order of Physicians, which did not join the complaint lodged by the Syndicat national des médecins homéopathes français against Mr O... and did not appeal against the decision of the disciplinary chamber of first instance, consequently did not have the status of a party on appeal before the national disciplinary chamber of the Order of Physicians ruling on the appeal by the Syndicat national des médecins homéopathes français and others, without the fact that it was required, pursuant to Article R. 4126-14 of the Public Health Code, to be joined in the proceedings in order to submit observations having any bearing in that regard. Nor would it have had standing to bring a third-party opposition against the order of 29 July 2025 on the ground that it had not been present in the proceedings. Accordingly, the appeal, insofar as it emanates from the departmental council of the Nord of the Order of Physicians, is inadmissible.
On the claims in the appeal:
On the one hand, under Article R. 4127-13 of the Public Health Code: "When a physician participates in an action to inform the public of an educational, scientific or health-related nature, whatever the means of dissemination, he shall refer only to confirmed data, exercise prudence and have regard to the repercussions of his statements on the public (...)."
The ethical requirements relating to the professional communication of physicians, set out in those provisions, are justified by the public interest attaching to the proper information of the public on health matters, which contributes to the protection of public health. Applied to communication directed at the public that forms part of a debate of general interest, they are intended to take account of the characteristics of the professional practice of physicians, which rests on a scientific method and knowledge, as well as the particular duties and responsibilities incumbent upon those practitioners vis-à-vis the public, having regard to the impact that their positions may have on the latter and to the risks that imprudent communication on their part could pose to public health. The restrictions on the freedom of expression of physicians that those rules are liable to justify must be strictly proportionate to those objectives.
On the other hand, under the first paragraph of Article R. 4127-56 of the Public Health Code: "Physicians must maintain relations of good collegiality among themselves."
It follows from the terms of the order under challenge that, in holding that Mr O...'s conduct constituted a breach of the duty of prudence and of regard for the repercussions on the public resulting from the provisions of Article R. 4127-13 of the Public Health Code, cited in point 4, as well as of the obligation of collegiality resulting from those of Article R. 4127-56 of the same Code, cited in point 6, the President of the national disciplinary chamber relied on the fact that the opinion piece contained, beyond a criticism of the non-conventional practices denounced, passages calling into question the ethics of the physicians who implement them and the danger of their attitude for their patients.
It appears, however, from the documents in the file submitted to the President of the national disciplinary chamber that, as the order under challenge itself notes, that opinion piece forms part of an old and recurrent debate on the subject of general interest concerning the efficacy of non-conventional care practices and refers to scientifically documented information. Moreover, that opinion piece confines itself to putting forward the viewpoint of its signatories on the endorsement given to those practices and the risks associated with them in terms which, while intended to stimulate debate, remain impersonal, without assuming an outrageous or defamatory character, and which were not such as to create a loss of confidence in the word of the medical profession or to give rise to a risk for the public. Consequently, in holding that that opinion piece exceeds the limits that the ethical requirements previously recalled justify placing on the freedom of expression of physicians and that its signature therefore constituted a breach of those ethical obligations, the President of the national disciplinary chamber gave an erroneous legal characterisation to the facts alleged against Mr O....
It follows from the foregoing that, without it being necessary to rule on the other grounds of his appeal, Mr O... is entitled to seek the annulment of the order of the President of the national disciplinary chamber of the Order of Physicians which he challenges.
In the circumstances of the case, it is appropriate to order the Syndicat national des médecins homéopathes français to pay Mr O... the sum of 3,000 euros under Article L. 761-1 of the Code of Administrative Justice. The same provisions preclude, having regard to what is stated in point 3, any grant of the claims presented on the same basis by the departmental council of the Nord of the Order of Physicians, as well as those directed, on the same basis, against the National Council of the Order of Physicians, which does not have the status of a party in the present proceedings.
DECIDES:
Article 1: The order of the President of the national disciplinary chamber of the Order of Physicians of 29 July 2025 is annulled.
Article 2: The case is remitted to the national disciplinary chamber of the Order of Physicians.
Article 3: The Syndicat national des médecins homéopathes français shall pay Mr O... the sum of 3,000 euros under Article L. 761-1 of the Code of Administrative Justice.

Article 5: The present decision shall be notified to the departmental council of the Nord of the Order of Physicians, to Mr D... O... and to the Syndicat national des médecins homéopathes français.
A copy shall be sent to the National Council of the Order of Physicians.

REPUBLIQUE FRANCAISE
1°) d'annuler cette ordonnance ;
- d'irrégularité en ce que la contestation soumise à la chambre disciplinaire nationale de l'ordre des médecins, qui ne relevait pas d'une série, aurait dû être jugée en formation collégiale ;
- d'irrégularité en ce qu'elle juge la requête d'appel recevable alors que le Syndicat national des médecins homéopathes français n'a pas produit la délibération de l'organe statutairement compétent décidant de relever appel de la décision de première instance ;
- d'erreur de droit et d'inexacte qualification juridique des faits en ce qu'elle juge que M. O... a méconnu les exigences résultant de l'article R. 4127-13 du code de la santé publique ;
Vu les autres pièces du dossier ;
Vu :
- le code de la santé publique ;
- le code de justice administrative ;
- les conclusions de M. Jean-François de Montgolfier, rapporteur public ;
